The agreement, and who can use Glowwer#
These Terms of Service are an agreement between you and DesignersGrid, Inc. (“Glowwer”, “we”, “us”), whose details are under Operator and contact. By pasting a website, creating an account, or otherwise using Glowwer, you agree to them, together with the Privacy Policy, the Refund & Cancellation Policy, the Acceptable Use Policy and the Copyright & IP policy. If you do not agree, do not use Glowwer.
- You must be at least 18 (or the age of majority where you live, if higher). Glowwer is a tool for businesses and is not offered to children.
- You must have authority. If you use Glowwer for a business, you confirm that you are authorised to act for it, to accept these terms on its behalf, and to connect its accounts and use its content. “You” then means you and that business.
What Glowwer does, and what is still early#
Glowwer reads the public website you give it, builds a brand profile you can review and correct, drafts a week of social posts for that brand, lets you approve, revise or skip each one, and publishes the approved posts to the social accounts you connect. Some features can be used without an account or payment; others require an account and, where we say so, a paid plan.
Glowwer is a new product and parts of it are in early release. Features may change, be added, or be withdrawn; some may be labelled as beta, preview or coming soon, and those are provided as-is while we finish them. We do not promise that the service will be uninterrupted or error-free, that a post will publish at a particular time, or that it will reach or engage any particular audience.
Your account#
- Give us accurate information and keep it current, especially the email we use to reach you.
- Keep your sign-in method secure and do not share your account. You are responsible for what happens under it until you tell us it has been compromised — write to hello@glowwer.com as soon as you suspect that.
- One account per person; you may manage more than one brand within it according to your plan.
Before you create an account, the draft you see is tied to an anonymous session and is reachable by anyone with its link; the Privacy Policy explains how that works and when unclaimed drafts are deleted.
Subscriptions and billing#
Paid plans are monthly subscriptions. The price, what the plan includes, and the number of brands it covers are shown on the pricing page and again before you confirm any purchase or plan change. Nothing is charged until you confirm it.
- Free weeks. A new business’s first two posts are free, with no card. When you add a card to unlock the rest of your first week, the following week is free too. Before you confirm, you see the date your free weeks end, and the date and amount of your first charge. Nothing is charged before that date. If you cancel before it, you are never charged. Each business can have free weeks once.
- Automatic renewal. A monthly plan renews automatically at the end of each billing period, at the then-current price for your plan, until you cancel. By subscribing you authorise our payment processor to charge your payment method for each renewal.
- Cancellation. You can cancel at any time; cancellation takes effect at the end of the paid period and you keep access until then. How to cancel, and when refunds apply, are in the Refund & Cancellation Policy, which is part of these terms.
- Price changes. If we change the price of your plan we will tell you by email before the renewal it applies to, so you can cancel first.
- Taxes. Prices exclude taxes unless we say otherwise. If a tax applies to your purchase, you will see it before you confirm; we never charge an amount you were not shown.
- Payment processing. Payments are handled by our payment processor under its terms; Glowwer never sees your full card number.
- Free use. Where a feature is free, we may limit it (for example, by the number of brands or by rate) and may change those limits.
Connected social accounts and third-party platforms#
To publish, you connect a social account through our publishing provider. The platform’s own consent screen tells you what you are authorising, and the platform’s terms govern your account there. You are responsible for complying with those terms, for the content published to your accounts, and for keeping the authorisation current.
Platforms change their rules, limits and interfaces without telling us, and may reject, delay, remove or restrict a post or an account for their own reasons. We will show you what we know about a post’s status, but we cannot guarantee a platform’s behaviour and are not responsible for it. You can disconnect any account at any time from Settings.
Your content, and what you are responsible for#
You own your inputs. Your website content, brand details, uploaded photos, logos and files, instructions, and messages (“your content”) remain yours. We claim no ownership of them.
Licence to us. So that we can run the service, you give Glowwer and the providers that run it a worldwide, non-exclusive, royalty-free licence to host, store, copy, analyse, adapt and display your content, and to send it to the AI and publishing providers we use, solely to provide the service to you, keep it secure, and improve it. This licence ends when your content is deleted, except for copies kept in routine backups for a limited time and records we must keep by law. We do not use your content to train models that serve other customers.
You are responsible for rights and permissions. When Glowwer reads your website, it may pick up photos, logos, fonts, reviews and text from it; when you upload files or connect an account, we rely on you. You confirm that, for everything you provide, keep, approve or connect:
- you own it or have permission to use it in social posts, including photos of people, customer reviews and testimonials, and any third-party logos, fonts, music or artwork;
- it does not infringe anyone’s copyright, trademark, privacy, publicity or other rights;
- any claim it makes about your business, products or results is true and substantiated, and complies with the advertising and consumer-protection rules that apply to you; and
- the social accounts you connect are yours to publish to.
We may remove content, or refuse to publish it, if we believe it breaches these terms or the Acceptable Use Policy; see also the Copyright & IP policy for how to report infringement.
Generated content#
Glowwer drafts captions, images, plans and suggestions with AI (“generated content”). As between you and Glowwer, and to the extent permitted by law, you may use the generated content we produce for you as your own, and we do not claim it — subject to the rights of others and to the rules below.
- It may not be unique. Similar prompts produce similar results; other customers may receive similar or identical content. We do not promise that generated content is original or protectable as your intellectual property.
- It may be wrong. Generated content can be inaccurate, incomplete, out of date, or misleading, and can misstate facts about your own business. We do not promise that it is accurate, non-infringing, appropriate, or legally sufficient for any purpose.
- You review and approve before it publishes. Nothing publishes without your approval, and by approving a post you take responsibility for it as your own content under Your content.
- It is not advice. The Creative Director and everything Glowwer generates is marketing assistance, not legal, tax, financial, medical or other professional advice. Where a post touches a regulated subject, check it with someone qualified.
- Third-party rights. Generated content may resemble existing works or include names, marks or likenesses that belong to others. Do not publish it in a way that infringes them.
Acceptable use#
You may not use Glowwer to publish or do anything unlawful, infringing, deceptive, harassing, hateful, sexually exploitative, or harmful, to send spam, to impersonate anyone, to distribute malware, or to bypass rate limits, platform rules or our security. The full list is the Acceptable Use Policy, which is part of these terms.
Glowwer’s intellectual property#
The Glowwer service — its software, models, prompts, designs, templates, name, logo and documentation — belongs to Glowwer and its licensors and is protected by intellectual-property law. These terms give you a limited, revocable, non-exclusive, non-transferable right to use the service as it is offered. You may not copy, modify, resell, reverse-engineer or scrape it, remove our notices, or use our name or logo without permission. “Glowwer” and the Glowwer mark are ours; other names and logos on the site belong to their owners.
Feedback#
If you send us ideas, suggestions or bug reports, you give us permission to use them without restriction or payment. We will never claim they are ours in a way that stops you using them too.
Third-party services#
Glowwer runs on third-party hosting, authentication, AI, publishing, messaging, analytics and payment services; the current list is the Subprocessors page. Their availability and behaviour affect ours. Content we read from public websites, listings and reviews is theirs, not ours, and we do not vouch for it.
Suspension, termination, and getting your data out#
By you. You can stop using Glowwer at any time. To end a paid plan, cancel as described in the Refund & Cancellation Policy. To have your account and content deleted, or to receive a copy of your content before that, make a request on the Privacy Rights Requests page from the email on your account. We will confirm the request, provide a copy of your content in a reasonable, commonly used format if you asked for one, and then delete your account and its content, except for records we must keep; the Privacy Rights Requests page says exactly what that covers today.
By us. We may suspend or end your access, with notice where practical, if you materially breach these terms or the Acceptable Use Policy, if your use creates legal or security risk for us or others, if a platform requires it, or if a paid plan goes unpaid after we have told you. We may also withdraw the service itself with reasonable notice. If we end your access without cause while you are on a paid plan, we will refund the unused part of the current period.
Effect. When access ends, we stop publishing for you, connected accounts are disconnected on our side (posts already on a platform stay there), and your content is deleted according to the Privacy Policy. Sections that by their nature should survive — your content responsibilities, disclaimers, limits of liability, indemnity, and the general terms — survive.
Disclaimers#
GLOWWER IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT GENERATED CONTENT WILL BE ACCURATE, ORIGINAL OR SUITABLE, OR THAT ANY POST WILL ACHIEVE ANY RESULT. Some places do not allow some of these exclusions; where that is so, they apply to the extent permitted.
Limitation of liability#
TO THE FULLEST EXTENT PERMITTED BY LAW, GLOWWER AND ITS OFFICERS, EMPLOYEES, CONTRACTORS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED US DOLLARS (US$100).
These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or wilful misconduct. Some places do not allow limits on certain damages; where that is so, the limits apply to the extent permitted.
Indemnity#
You will defend and indemnify Glowwer against third-party claims, and the reasonable costs of them, that arise from (a) your content, including content you approved for publishing, (b) your breach of these terms, the Acceptable Use Policy, or a platform’s terms, or (c) your misuse of the service. We will tell you promptly about any such claim and let you control the defence, and we will not settle it on your behalf without your consent. This does not cover claims caused by our own breach or misconduct.
Changes to these terms#
We may update these terms. We will post the new version here and update the date at the top; if a change materially affects your rights or obligations we will tell account holders by email or with a notice in the product at least 14 days before it takes effect, unless the change is required by law or addresses a security or legal risk, in which case it may take effect sooner. Continuing to use Glowwer after a change takes effect means you accept it; if you do not, stop using the service and, if you are on a paid plan, cancel it.
Governing law and disputes#
Not yet designated. These terms do not currently select a governing law or an exclusive forum. They contain no arbitration requirement and no class-action waiver. Any dispute will be resolved under the law that applies to it, in the courts that have jurisdiction over it, and nothing here takes away consumer-protection rights you have under the law of the place where you live. When a governing law and venue are designated they will appear here, with notice under Changes to these terms.
Before either of us starts formal proceedings, we ask for a good-faith attempt to resolve the matter by writing to hello@glowwer.com (or, from us, to the email on your account) and allowing 30 days.
General#
- Entire agreement. These terms, with the policies they incorporate, are the whole agreement between you and Glowwer about the service and replace any earlier understanding.
- Severability. If a part of these terms is found unenforceable, the rest still applies and the part is replaced by the closest enforceable version.
- No waiver. Not enforcing a term is not a waiver of it.
- Assignment. You may not transfer these terms without our written consent; we may transfer them in a merger, acquisition or sale of assets, with notice to you.
- Notices. We send notices to the email on your account; you send them to hello@glowwer.com or the postal address under Operator and contact.
- No third-party beneficiaries, except that the providers named on the Subprocessors page may rely on the limits and disclaimers above.
